Mold in Your Rental? A Los Angeles Tenant’s Guide to Mold Testing

Finding mold in an apartment or rental home is stressful, especially when you and your landlord don’t agree on how serious it is. This guide explains what California law says about mold, how to document the problem, and when independent mold testing can help renters and landlords in Los Angeles resolve it.

What California law says about mold

Since 2016, California’s housing law (Health and Safety Code §17920.3, updated by Senate Bill 655) lists visible mold growth as a condition that can make a dwelling substandard. The law excludes mold that is minor and found on surfaces that collect moisture as part of their normal use, such as a small spot on shower grout. Whether a condition qualifies is determined by a local health officer or code enforcement officer.

In practice, this means that significant visible mold in a rental is a habitability issue that local code enforcement can inspect, not just a cosmetic complaint.

Step 1: Document everything

  • Take dated photos and videos of any visible mold, water stains, leaks or condensation.

  • Note musty smells, when they are worst and in which rooms.

  • Keep a log of any health symptoms and when they occur.

  • Notify your landlord or property manager in writing (email or letter) and keep a copy.

Step 2: Understand when testing helps

If mold is clearly visible, the priority is fixing the moisture source and cleaning it up. But an independent, lab-verified test is valuable when:

  • You smell mold but can’t see it, for example behind walls, under flooring or in the HVAC system.

  • The landlord says the problem is “just dirt” or “just condensation.”

  • The landlord painted over a stain and you want to know whether the problem is still there.

  • You need objective results to share with the landlord, code enforcement, an attorney or your doctor.

  • You want to confirm that the air is back to normal after repairs.
